[highlights] the key soft science project of the State Intellectual Property Office chaired by Yang Yonggang was successfully concluded

Recently, the key soft science project "Research on the coordinated development of trademarks and geographical indications" (ss20-a-02) of the State Intellectual Property Office, chaired by Yang Yonggang, President of Beijing Nongzhi Institute of geographical indications, was successfully concluded, and the State Intellectual Property Office issued the completion certificate to the research group.

For a long time, there has been a serious problem in the development of geographical indications in China, that is, there is no unified legal system of geographical indications, which leads to the phenomenon of conflicting "tragedy of the commons" from time to time when declaring, protecting and promoting geographical indications and dealing with the relationship between enterprise trademarks and geographical indications. Therefore, it is particularly important to correctly deal with the relationship between trademarks and geographical indications, formulate a separate geographical indication law, strengthen the protection of geographical indications and promote their coordinated development.

Through legal analysis, the research group conducted field visits and investigations in Hainan, Guangdong, Beijing, Shanghai, Shandong, Sichuan, Chongqing, Zhejiang, Jiangsu and other places, and made horizontal analysis of the main foreign models. On this basis, after full discussion, the research group put forward corresponding suggestions on how to make the coordinated development of trademarks and geographical indications. Finally, it puts forward the preliminary design and prediction of the formulation of the geographical indications law of the people's Republic of China from the aspects of legislative logic, legislative technology and market effect.
