2021 world geographical indication conference held, origin brands gathered in Beijing

According to Director Zhou, geographical indications are internationally recognized important types of intellectual property rights. These logo products contain local unique natural and local conditions, are the precipitation of traditional culture and an important carrier to support high-quality economic development. By the end of June this year, a total of 2478 geographical indication protection products had been approved, 6339 of which had been registered as collective trademarks and certification trademarks. The total number of market entities that met the conditions for the use of special signs for collective signs had exceeded 14000, and the annual capital output value of geographical indication products had been close to 700 billion. China is a big country with intellectual property marks. The protection, management and development of geographical indications are of great significance to drive local development of special industries and Rural Revitalization.

Zhang Zhicheng, director of the intellectual property protection department of the State Intellectual Property Office, pointed out the protection mechanism and future development direction of geographical indications in China. According to reports, China's geographical indications have made new progress in many aspects, such as the construction of supervision mechanism, the construction of demonstration areas, the level of geographical indication protection, international cooperation in geographical indication protection and so on. In the next step, we should give full play to the institutional advantages of geographical indications, better promote the decisive battle of geographical indications, overcome poverty and Rural Revitalization and development strategy, and serve the high-level opening-up.

Chen Yusong, the second level inspector (deputy director level) of the Department of treaty and law of the Ministry of Commerce, mentioned in the keynote speech on strengthening the protection of China EU landmark brands and promoting the development of bilateral trade that the China EU agreement on geographical indications will officially enter into force on March 1, 2021. The agreement has three characteristics, including large number of protection, high level of protection and great impact. According to Chen Yusong, the agreement is the first large-scale mutual recognition of each other's geographical indications between China and the EU. The first batch of 96 European and 100 Chinese geographical indications have been protected in China and Europe respectively when the agreement enters into force, and the second batch of 175 geographical indications of both sides will be protected within four years after the agreement enters into force. A total of more than 500 geographical indications on both sides can be protected under the agreement. At present, 134 European Union geographical indications and 110 Chinese geographical indications are protected in China and Europe respectively, of which the agreement contributes 72% and 91% respectively.

The consultant literature system of the China Office of the world intellectual property organization introduces the Lisbon system for the international protection of names of origin and geographical indications managed by the world intellectual property organization. It is understood that the Lisbon system consists of the Lisbon Agreement and the Geneva text, which is managed by the world intellectual property organization. On February 26, 2020, the Geneva text of the Lisbon Agreement on names of origin and geographical indications officially entered into force, which can be regarded as an important milestone in the development and growth of the Lisbon system. The agreement covering geographical indications has expanded the scope of intellectual property protection and improved the global protection system. So far, the Lisbon system covers 55 countries, including 1141 international registrations of names of origin and 1 international registration of geographical indications.

Jin Xuejun, President of Beijing Intellectual Property Court, introduced at the 2021 world brand distribution service conference of geographical indication products of origin that from the establishment of the court to August this year, the Beijing Intellectual Property Court has heard 53 administrative cases involving the authorization of geographical indication trademarks, 78 administrative cases involving the confirmation of geographical indication trademarks and 43 civil infringement cases involving geographical indication trademarks. The characteristics of the cases are embodied in three aspects: there are more administrative cases related to the authorization and confirmation of geographical indication brand layout, more cases related to regional industrial brand development and social mass consumption, and more foreign-related cases related to the international trade and competition of geographical indication products. In the cases of regional industrial brand development and social mass consumption, from the perspective of sign categories, the goods or services involved in the geographical indication case have covered more than 20 of the 45 categories of trademark application and registration. Among them, the number of cases involving geographical indications of agricultural products is the largest, involving nearly 20 industrial categories such as fruits and vegetables, tea, medicinal materials and tobacco.

Peng Daming, agricultural counsellor of the European Union delegation in China, introduced that the China EU agreement on geographical indications officially entered into force on March 1, 2021, which is the first comprehensive and high-level bilateral agreement on geographical indications. There are 196 geographical indication products under protection in the first batch. The European Union geographical indications are mainly concentrated in wine (56%), spirits (16%) and cheese (12%), etc. the European Union geographical indication product categories are relatively concentrated, with 14 product categories. The 100 Chinese geographical indications are mainly concentrated in vegetables (45%), tea (28%), wine and spirits (11%), and the Chinese product categories are relatively scattered, with 43 product categories. For producers, the implementation of the China EU agreement on geographical indications is conducive to rural development and "Rural Revitalization" by maintaining employment and economic activities in rural areas (such as agricultural tourism); The EU geographical indication system also brings "Three Guarantees" to consumers, that is, to ensure the origin, quality and authenticity of products. Provide guarantee through production place and market supervision, and bring commercial and trade advantages to the whole supply chain from producers to consumers.

Xie Huaping, director of the urban and rural development research center, mentioned in his speech that China is rich in geographical indication resources. These geographical indication products are well known to ordinary people because of their remarkable natural geographical characteristics, special commercial value and widespread reputation, such as Yangcheng Lake hairy crab, Wuchang rice, Pinggu peach, Ningxia medlar and so on. From the aspects of excavating cultural connotation, optimizing business environment, strengthening scientific and technological innovation, paying attention to brand incubation, strengthening financial innovation services and strengthening landmark market publicity, we will continue to optimize the ecological space of rural production and life and stimulate the vitality of rural development. Strengthening the creation, application and protection of geographical indications can improve the quality and added value of geographical indication products, establish the consumption confidence of independent brands, and meet people's higher-level material and cultural needs.
